Decisions regarding fees and registration procedures, organization and classification of copyright on works and the establishment of the National Council for Copyright

On 01.18.2017, the Council of Ministers adopted the decision no. 33, no. 34 and no. 35 which respectively determine the fees for services provided by the Directorate of Copyright, registration, organization and classification procedures of works of copyright and the functioning, organization and remuneration of the National Council for Copyright.

By decision no. 33, the Council of Ministers adopted the fees for services provided by the Directorate of Copyright, which are listed in Annex 1.   Payments provided for in this Decision shall be carried out at the account of the Ministry of Culture, Department of the Treasury and shall be paid into the state budget.

By decision no. 34, the Council of Ministers adopted the registration, organization and administrative classification procedures of copyright. According to the decision procedures of registration and issuance of the certificate of copyright are carried out by the Directorate of Copyright (DoC) to the Ministry responsible for copyright. DoC reviews and registers any application for registration of copyright and other rights relating thereto for the applying author or handler / holder of copyright on a work.

In terms of organization and administrative classification of the registry of copyright it is done in the following order:

a) Registration of copyright and other rights related thereto;

b) Registration of contracts and agreements that are subject to copyright and other rights related thereto (associated with additional documents that prove the transfer of rights from the owner or author of the work toward the holder of acquired rights);

c) Registration of Collective Management Agency of copyright and other rights related thereto, licensed, as well as any information that these agencies are obliged to submit to DoC;

ç) Certificate provided for any rights registered and / or any transfer of rights, as required by law no. 35/2016, “On copyright and other rights related thereto”;

d) Deposit, according to article 104 of Law no. 35/2016, “On copyright and other rights relating thereto”.

Finally, regarding the copyright, the Council of Ministers adopted the decision no. 35 which establishes a new body named the National Council for Copyright, a specialized body for setting payment fees on the use of works of copyright and other rights related thereto in the collective administration, subject to the determination of the law on copyright.

National Council for Copyright is a collegial decision-making and advisory body, at the Ministry responsible for copyright and is composed of the Chairperson and four (4) members.
